Usage Policy and Terms of Service

This agreement (the "Agreement") governs access to and use of the CynQ management platform (the "Tool," the "Platform," the "Service"), operated by Consultants Crac! Inc.("CynQ," "we," "us," "our") by any client company (the "Client," "you").

By creating an account, accessing the Platform, or paying for a subscription, you agree to be bound by this Agreement.

1. Definitions

Customer: any company or legal entity subscribing to CynQ.

Authorized user: any person to whom the Customer grants access to the Platform.

Account administrator: user authorized to manage access, settings, and billing.

Data: any information, file, or content uploaded or generated in CynQ.

Platform/Service: the CynQ application offered in SaaS mode.

Subscription: monthly or annual plan, including a base rate and, where applicable, fees per active user.

2. Purpose

CynQ is cloud-based project and construction site management software. This Agreement applies to all use of the Service, whether free or paid.

3. Account creation and management

The Customer is responsible for the accuracy of the information provided, the creation of users, and the management of access.

Each authorized User must have a unique, personal, and nominative identifier.

It is strictly prohibited to share a username or password, or to allow multiple people to use the same account simultaneously.

Any activity carried out from an account is deemed to have been carried out with the Customer's authorization.

4. Subscription and billing

CynQ is available on a subscription basis. Fees are charged according to the chosen package and the number of active users.

CynQ reserves the right to adjust its prices with reasonable notice.

5. License and access

CynQ grants a limited, non-exclusive, non-transferable license for the duration of the subscription.

Any attempt to circumvent the rules of use or billing constitutes a violation of this Agreement.

6. Storage and files

Storage is reserved for files that are relevant and directly related to projects and construction sites.

It is prohibited to use CynQ as a general-purpose storage solution or for personal archiving.

CynQ may impose reasonable limits and intervene in cases of misuse.

7. Acceptable use

Any misuse, illegal use, or use that compromises the security or fairness of the Service is prohibited.

Sharing credentials and irrelevant storage constitute misuse.

8. Security and data

The Customer remains the owner of their Data. CynQ may process it solely for the purpose of providing the Service.

9. Termination

The Customer may terminate their subscription in accordance with the terms and conditions. Amounts paid are non-refundable.

CynQ may suspend or terminate an account in the event of non-compliance with the Agreement.

10. Limitation of Liability

The Service is provided "as is." CynQ's liability is limited to the amounts paid during the last 12 months.

11. Applicable law

This Agreement is governed by the laws of the Province of Quebec.
