Terms of Use and Conditions of Service<\/h3>

This agreement (the “Agreement”) governs access to and use of the CynQ management platform (the “Tool”, the “Platform”, the “Service”), operated by Consultants Crac! Inc.<\/strong> (“CynQ”, “we”, “our”, “us”), by any client company (the “Client”, “you”).<\/p>

By creating an account, accessing the Platform, or paying for a subscription, you agree to be bound by this Agreement.<\/p>

1. Definitions<\/h3>

Client: any company or legal entity subscribing to CynQ.<\/p>

Authorized User: any person granted access to the Platform by the Client.<\/p>

Account Administrator: user authorized to manage access, settings, and billing.<\/p>

Data: any information, file, or content uploaded or generated in CynQ.<\/p>

Platform \/ Service: the CynQ application offered as SaaS.<\/p>

Subscription: monthly or annual plan, including a base rate and, where applicable, fees per active user.<\/p>

2. Purpose<\/h3>

CynQ is a cloud-based project and site management software. This Agreement applies to all use of the Service, whether free or paid. <\/p>

3. Account Creation and Management<\/h3>

The Client is responsible for the accuracy of information provided, user creation, and access management.<\/p>

Each Authorized User must have a unique, personal, and named identifier.<\/p>

It is strictly prohibited to share an identifier or password, or to allow simultaneous use of the same account by multiple persons.<\/p>

Any activity performed from an account is deemed to have been performed with the Client’s authorization.<\/p>

4. Subscription and Billing<\/h3>

CynQ is offered by subscription. Fees are billed according to the selected plan and the number of active users. <\/p>

CynQ reserves the right to adjust its prices with reasonable notice.<\/p>

5. License and Access<\/h3>

CynQ grants a limited, non-exclusive, and non-transferable license for the duration of the subscription.<\/p>

Any attempt to circumvent usage or billing rules constitutes a violation of this Agreement.<\/p>

6. Storage and Files<\/h3>

Storage is reserved for relevant files directly related to projects and sites.<\/p>

It is prohibited to use CynQ as a general storage or personal archiving solution.<\/p>

CynQ may impose reasonable limits and intervene in case of abusive use.<\/p>

7. Acceptable Use<\/h3>

Any abusive, illegal, or use that compromises the security or fairness of the Service is prohibited.<\/p>

Sharing identifiers and non-relevant storage constitute abusive uses.<\/p>

8. Security and Data<\/h3>

The Client remains the owner of its Data. CynQ may process it solely to provide the Service. <\/p>

9. Termination<\/h3>

The Client may terminate its subscription according to the terms provided. Amounts paid are non-refundable. <\/p>

CynQ may suspend or terminate an account in case of non-compliance with the Agreement.<\/p>

10. Limitation of Liability<\/h3>

The Service is provided “as is”. CynQ’s liability is limited to amounts paid over the past 12 months. <\/p>

11. Applicable Law<\/h3>
